Open Question: Spiritually and ethically speaking, if artificial intelligence could mimic human emotion, pain and empath

Mimic perfectly that is.

What is the actual, scientifically proven distinguishable factor that would separate our emotions, pain and empathy from those of the artificial intelligence? What would be the religious or spiritual factors that would be measurable or distinguishable also (other than a soul, since you cannot measure or even observe a soul)?

Would we morally have to treat them as equal, since they express their empathy and emotions equal to ourselves?

Note: this is referring to a common theme expressed in science-fiction books and films.
